Whiplash Injuries After a Car Accident: Why They Should Not Be Ignored

A rear-end collision can happen in seconds. The physical consequences from the car accident may last much longer.

Whiplash is commonly associated with motor vehicle collisions and can cause neck pain, stiffness, headaches and other symptoms. For some people, symptoms improve relatively quickly. For others, they can persist and interfere with work, sleep and everyday activities.

What Is Whiplash?

Whiplash generally refers to an injury involving the neck caused by a sudden acceleration and deceleration of the head and neck.

It is commonly associated with rear-end collisions, but similar forces can occur in other types of crashes.

Symptoms can include:

  • Neck pain
  • Neck stiffness
  • Headaches
  • Shoulder pain
  • Dizziness
  • Reduced range of motion
  • Fatigue
  • Concentration difficulties
  • Sleep problems

Not every person experiences the same symptoms.

Why Do Symptoms Sometimes Appear Later?

A person involved in a collision may feel relatively well immediately afterward.

Adrenaline can mask pain, and some symptoms may develop over the following hours or days.

That is why medical assessment after a collision can be important, particularly when symptoms develop or worsen.

Do not dismiss persistent symptoms simply because the vehicle suffered only minor damage.

Ontario's Minor Injury Guideline

Ontario's automobile insurance system contains a Minor Injury Guideline that addresses certain minor injuries arising from automobile accidents. FSRA identifies the Minor Injury Guideline as an active guideline within Ontario's auto insurance framework.

The existence of the guideline does not mean that every person with neck pain has the same claim or recovery.

The nature, severity and duration of the injury matter.

A person's symptoms, medical findings, treatment and functional limitations should be properly documented.

What Should You Do After a Collision?

First, obtain appropriate medical attention.

Then follow recommended treatment and keep records.

Useful documentation includes:

  • Medical appointments
  • Physiotherapy
  • Prescriptions
  • Specialist appointments
  • Missed work
  • Travel for treatment
  • Out-of-pocket expenses
  • Changes in household responsibilities
  • Changes in recreational activities

Keep a simple symptom journal if your symptoms are persistent. It can help your healthcare providers understand how the injury is affecting your daily life.

Don't Compare Your Injury With Someone Else's

One person may recover from a neck injury in a few weeks. Another may continue to experience significant symptoms.

There is no universal timeline that applies to every collision victim.

The severity of the impact is also not necessarily a reliable measure of the severity of the resulting injury.

A relatively modest collision can cause substantial symptoms in some people.

Insurance Benefits and Personal Injury Claims Are Different Questions

Following an Ontario automobile accident, an injured person may have access to statutory accident benefits. Depending on the circumstances, benefits can address categories such as medical and rehabilitation expenses and income replacement.

Ontario's accident benefits regulations also contain specific rules concerning treatment, assessments and benefit limits.

Whether someone also has a claim against another party for damages is a separate legal question.

That distinction can be important.

When Should You Talk to a Lawyer?

If your symptoms persist, interfere with your employment or daily activities, or appear more significant than initially expected, consider obtaining legal advice.

A personal injury lawyer can review the circumstances of the collision, the medical evidence and the applicable insurance rules.

Deutschmann de Koning Law in Kitchener helps people injured in motor vehicle collisions understand their rights and options.

Whiplash should not be dismissed simply because it is common. If an injury is affecting your life, it deserves appropriate medical attention—and, where necessary, careful legal consideration.
